This is a courtesy translation. The German AGB is the legally binding version under German law.

§ 1 Scope

These terms apply to all purchases of original paintings, fine art prints and accessories, and to commissions, ordered via michisillustrations.com from Michelle Yasmine Laskowski, Michis Illustrations (see Legal Notice).

§ 2 Conclusion of contract

Listings in the shop are an invitation to order, not a binding offer. Submitting an order via checkout is your binding offer; the contract is formed once payment is confirmed. For commissions, the contract forms once subject, size and price are mutually confirmed and paid in full (see § 6).

§ 3 Prices and payment

All prices shown are final prices. Under § 19 UStG (German small-business exemption), no VAT is charged or shown. Payment is processed via Stripe (card, PayPal, Klarna, SEPA direct debit).

§ 4 Shipping

Shipping is currently limited to Germany. See the Shipping page for rates and delivery times per category.

§ 5 Retention of title

Delivered goods remain the property of Michis Illustrations until paid in full.

§ 6 Commissions

Commissions are made to your individual specification. Full payment is due before work begins, via the link in your commission confirmation. As custom-made goods, commissions carry no statutory right of withdrawal under § 312g (2) no. 1 BGB (seeRight of Withdrawal).

Cancellation policy: cancelling before the sketch is approved refunds the full amount minus a 15% sketch fee (min. €50). No refund is possible after sketch approval.

§ 7 Warranty

Statutory warranty applies. As originals are handmade, unique pieces, minor variation in colour and texture from product photos is not a defect where it reflects the character of a hand-painted work.

§ 8 Liability

We are liable without limitation for intent and gross negligence, and under the Product Liability Act. For slight negligence, liability is limited to breaches of material contractual obligations, capped at foreseeable damage typical for this type of contract.

§ 9 Dispute resolution

The European Commission provides an ODR platform: ec.europa.eu/consumers/odr. We are not obliged or willing to take part in dispute resolution before a consumer arbitration board.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
